Critical Moment for Transgender Youth – And the Work Ahead
On Tuesday, March 3, the U.S. Supreme Court issued an order that temporarily blocks California’s policies designed to protect transgender students from being outed to their parents without their consent while litigation continues. The case centers on whether schools may keep a student’s gender identity confidential at school when disclosure could put that student at risk
“This decision is deeply disappointing,” says Nikhil Vashee, Senior Director of Education Law & Policy at Family Equality. “Once again, the Court is putting politics ahead of the safety and dignity of transgender youth. But families and educators don’t need permission to do the right thing. We will continue creating affirming, supportive spaces where every child can thrive.”
At a moment like this, it is important to name clearly what is at stake: transgender young people, like all children, deserve environments where they can be safe, affirmed, and supported. Policies that protect the confidentiality of a child’s gender identity are not abstract legal theories. For many youth, they are a matter of personal safety and emotional well-being.
While this legal battle continues, our work does as well.
Family Equality will continue to:
- ADVOCATE by driving policy change in Congress, state legislatures, and local districts to defend transgender youth and ensure schools are inclusive and welcoming to all.
- COMMUNICATE by strengthening community infrastructure so LGBTQ+ families and allies have reliable networks of support and spaces where they belong – especially when public debate creates confusion and fear.
- EDUCATE by equipping families and decision-makers with credible research, practical guidance, and authentic stories that move conversations from rhetoric to reality.
Many parents – including LGBTQ+ parents and parents of transgender youth – are navigating complex and deeply personal conversations at home. And not all young people have affirming support in their households. That is why schools must remain places where students can learn without fear and fully as themselves.
Courts may shape policy, but families shape the future. And together we’re creating the world where every child can thrive – safely and authentically.
